Terms of Use

Thihn Learn

Please read these Terms of Use carefully. By using the platform, creating an account, or benefiting from any of its services, you agree to be bound by these terms.

1. Definitions

The following terms shall have the meanings assigned to them unless the context requires otherwise:

  • Platform: Thihn Learn and all its electronic services and applications.
  • Company: Thihn Educational Company, owner and operator of Thihn Learn.
  • Educational Entity: Any university, institution, company, training center, or trainer that uses the platform to provide its educational services.
  • User: Any person who uses the platform, whether a visitor, trainee, trainer, administrator, or representative of an Educational Entity.

2. Acceptance of Terms

By using Thihn Learn, you acknowledge that you:

  • Have reviewed these terms.
  • Agree to be bound by them.
  • Undertake to comply with all applicable laws and regulations of the Kingdom of Saudi Arabia.

If you do not agree to any of these terms, you must refrain from using the platform.

3. Account Creation

The User undertakes to:

  • Provide accurate and up-to-date information.
  • Maintain the confidentiality of login credentials.
  • Not share the account with any other person.
  • Update their information upon any change.
  • Assume full responsibility for all activities carried out through their account.

The platform reserves the right to suspend or cancel any account where unlawful or non-compliant use is suspected.

4. Use of the Platform

The User agrees to use the platform solely for legitimate educational purposes and is prohibited from:

  • Using the platform in violation of laws or public decency.
  • Uploading or publishing any illegal, offensive, or infringing content.
  • Attempting to hack the platform or bypass security measures.
  • Disrupting or adversely affecting the performance of the platform or its services.
  • Using any automated tools or bots to extract data without written consent.
  • Impersonating any User or entity.

5. Educational Content

Thihn Learn enables Educational Entities to create, manage, and publish educational content.

The Educational Entity or content owner bears full responsibility for:

  • The accuracy of the content.
  • The quality of the content.
  • Compliance with intellectual property rights.
  • Obtaining all necessary licenses to publish the content.

Thihn Learn assumes no responsibility for content published by Educational Entities or Users.

6. Registration and Payment

Some services or courses may require payment of fees.

The User agrees that:

  • All displayed prices are subject to what the Educational Entity determines.
  • Payments are processed through accredited payment service providers.
  • The refund or cancellation policies of the Educational Entity apply, unless otherwise stated.

7. Refund Policy for Educational Entity Subscriptions

This policy applies to amounts paid by Educational Entities for subscriptions to Thihn Learn or for obtaining any of its paid packages or services.

This policy does not apply to amounts paid by trainees or beneficiaries to Educational Entities for courses, programs, or educational services provided by those entities through the platform; each Educational Entity is required to establish its own refund and cancellation policy, present it to its beneficiaries, comply with its implementation, and bear full responsibility therefor.

An Educational Entity subscribed to Thihn Learn may request a refund of the subscription amount subject to the following conditions:

  • The Educational Entity may submit a refund request within no more than seven (7) calendar days from the date of successful payment.
  • The seven-day period begins from the date and time of payment confirmation.
  • After the seven-day period, the Educational Entity is not entitled to cancel the subscription or claim a refund, in whole or in part.
  • The refund request must be submitted through the account registered in the name of the Educational Entity or by an authorized person.
  • The request must include the subscription details, invoice number or payment transaction number, and any other information requested by Thihn Learn to verify the request.
  • The refund request is subject to review and verification of data accuracy and compliance with the period specified in this policy.
  • Submitting a refund request does not constitute automatic approval of the refund; approval is only granted after verifying that all conditions are met.

Upon approval of the refund request, the amount due shall be returned to the original payment method used to make the payment, and the amount may not be transferred to another account or payment method.

Refunds are processed through the electronic payment gateway linked to the platform, including the "Maysar" gateway, and in accordance with its procedures and the requirements applicable to payment networks, banks, and card issuers.

The refund may take a period of time that varies depending on the payment gateway, payment method, and issuing bank. Thihn Learn assumes no responsibility for any delay caused by the payment gateway, bank, or any external party after the refund request has been processed by the platform.

The Educational Entity's subscription and continued use of the platform after the expiry of the seven-day period shall constitute final acceptance of the subscription and an acknowledgment that it is not entitled to claim a refund after the specified period has elapsed.

The expiration or cancellation of the subscription shall not affect the Educational Entity's liability for any obligations or amounts due that arose prior to the date of cancellation or refund.

8. Certificates

The platform may issue electronic completion certificates upon fulfilment of the course or program requirements.

Certificates may not be altered, used in a misleading manner, or forged. The platform or the Educational Entity reserves the right to cancel any certificate issued as a result of incorrect data or practices.

9. Intellectual Property

All intellectual property rights related to the platform, including but not limited to:

  • Software.
  • Design.
  • User interfaces.
  • Databases.
  • Logos.
  • Trademarks.
  • Source code.
  • Features and functions.

Are owned by Thihn Educational Company, and may not be copied, reused, distributed, or modified without prior written consent.

Educational content remains the property of its owners or the Educational Entities that published it, unless otherwise stated.

10. Availability and Support

Thihn Learn strives to provide its services with the highest levels of reliability, but does not guarantee uninterrupted service at all times.

The platform may carry out:

  • Maintenance work.
  • Updates.
  • Improvements.
  • Technical modifications.

Which may result in temporary disruption of certain services.

11. Limitation of Liability

To the fullest extent permitted by law:

  • Thihn Learn shall not be liable for any indirect or consequential losses arising from the use of the platform.
  • The platform shall not be liable for the accuracy of content published by Educational Entities or Users.
  • The platform shall not be liable for any services or products provided by third parties with which it is integrated.

12. Suspension or Termination of Account

The platform may suspend, restrict, or terminate any account in the event of:

  • Violation of these Terms of Use.
  • Misuse of the platform.
  • Infringement of the rights of others.
  • Engagement in any activity that threatens the security of the platform or its Users.

Without prejudice to any other legal rights.

13. Amendments

Thihn Learn may amend these terms at any time, and amendments shall become effective from the date they are posted on the platform or website.

Continued use of the platform after the posting of amendments constitutes acceptance thereof.

14. Governing Law

These terms are governed by the laws of the Kingdom of Saudi Arabia, and any dispute shall be resolved within the jurisdiction of the competent courts and judicial authorities of the Kingdom of Saudi Arabia, unless the law requires otherwise.
